OnrecordPlain English. By installing or using Onrecord you agree to these terms.
Onrecord is operated by Joel Holomek, a sole trader based in Australia. It is desktop software for car dealerships that records sales conversations, keeps notes against a deal, tracks commission, and builds a follow-up calendar.
Onrecord is not open to the public. Access requires a seat assigned by the dealership that licenses it, and you sign in with the Google account associated with that seat. Installing the app without a seat gives you no access. You must not share your sign-in, or use a seat assigned to somebody else.
Onrecord records conversations. Laws about recording differ across Australian states and territories, and several require the consent of every person being recorded. You are responsible for obtaining any consent the law requires before you record.
By using the recording features you confirm that:
We provide the tool. We are not a party to your conversations, we do not obtain consent on your behalf, and we are not responsible for recordings made unlawfully. Your dealership is responsible for setting policy and for training staff on it.
Recordings and notes are stored on the Mac they were made on. They are not uploaded to us. That also means they are only as secure as the machine holding them — keep it locked, encrypted, and under your control, and remember that anyone with access to that Mac may have access to the recordings.
Where the app sends a summary or note to a connected system such as HubSpot, that data is then governed by that system’s terms and by your dealership’s arrangements with it.
Conversations recorded through Onrecord will contain other people’s personal information. Handling it is subject to Australian privacy law and to your dealership’s own obligations. Do not retain recordings longer than you need them, and delete them when the reason for keeping them has passed.
Onrecord updates itself. Installing an update means the current version of these terms applies. We may change, suspend, or discontinue features at any time.
To the maximum extent permitted by law Onrecord is provided “as is”, and we are not liable for indirect or consequential loss, for lost recordings, or for any consequence of recordings made without the consent the law required. Nothing here excludes any guarantee or remedy under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where liability can be limited, it is limited to resupply or the cost of resupply.
Governed by the laws of Australia, with disputes subject to the non-exclusive jurisdiction of the Australian courts.
